Gallery Furniture Suspect Threatens Mattress Mack Behind Bars

"It was done in the Montgomery County Jail where a relative went to visit him. The relative came out after the visit and told the jailer that if he gets out (of jail) he's going to kill Jim McIngvale," said Harris County Assistant District Steve Baldassano.

Today a judge refused sixty-seven year old Robert Gillham's request to have his bail lowered. The bail still sits at a half million dollars, and that means Gillham is still sitting in jail because he can't come up with the money to get out.

"He has a lot of animosity toward McIngvale. He worked there for 15 years. He was fired. He's probably pretty angry. Whether he acts on something like that I think it's pretty hard to tell," said Baldassano.

In addition to the warehouse fire that caused 25 million dollars in damage, Gillham is under investigation for another crime too. He's accused of burglarizing a house in Montgomery County.

We don't know much about the rift between Gillham and Mattress Mack, but we do know it was serious enough to have resulted in court action.

"There was permanent injunction filed against him (Gillham) to stay away from that place in 2007," Baldassano said.

Gillham's Attorney says if his client wanted to harm McIngvale he could have done it years ago. He also says his client is in poor health, blind in one eye, and on medication for depression. Gillham was hoping for house arrest with a G.P.S. monitor.
